Property Management Fees Explained

 When you hire a property management company to serve as the liaison between yourself and your tenants, you want to be sure you're getting the best possible property management services for the money. The services a property management company provides can range from ala carte to an all-in-one inclusive package. Along with that comes an array of fees for each. There is no set in stone fee structure we can provide you. But we can educate you on what common fees to expect and what each is commonly for. In the end it will be up to you to compare company fee structures and choose the best one that fits within your budget. Below are some of the most common fees and what service they provide.

Commission

This is an ongoing monthly fee charged to the owner to compensate the property manager for the responsibilities of overseeing the management of their property. This fee can vary from as little as 3% to over 15% of the monthly gross rent. In place of a percentage some managers may charge a flat monthly amount which again can vary from to over 0 per month. All property management companies generally charge this fee.

Property Management Fees Explained

Lease-Up or Setup Fee

This fee is charged to the owner to compensate the property manager for their initial time invested and resources used in setting up an owners account; showing property and/or other activities resulting in tenant placement. I guess you could look at it as a "finders fee" for placing a tenant in your property. Once a tenant has been placed and first rent income comes in, the property manager will deduct this fee from the rent proceeds. Some property managers have been known to require this fee upfront prior to tenant procurement. Usually this fee is non-refundable once the property manager has started the process of tenant procurement or any legwork has been initiated with the property. This fee can vary from none to as much as the first months rent, and usually is a one-time fee per tenant.

Lease Renewal Fee

This fee is charged to the owner when a property manager renews a current tenants lease and covers the costs of initiating paperwork or communication involved in implementing the new lease document. A property manager may also justify this fee if they perform a year end inspection of property. This fee can vary from none to 0 or higher, and may be charged every time a lease renewal is implemented.

Advertising Costs

Depending upon the property management company's contract, either they will pay the advertising costs or the owner or they could split the costs. If the manager is willing to cover this cost, most likely they will charge the lease-up or setup fee as outline above. If the management company covers this cost make sure to find out what type advertising or marketing of your property is included. If it's placing your listing on their own web site and other free online classified sites you may not be getting your monies worth. They are many good rental or tenant resource online web sites that bring in qualified tenants for a reasonable fee and you will want to consider these. And don't forget about print media, yard signs, listing on the MLS or even an open house. Nothing is worst than having your property vacant, bringing in no money only because you or your property manager skimped on advertising.

Maintenance Mark-up Charges

This is one of those costs you may never really of known about or had it disclosed to you. A "Mark-up" is a charge over and beyond the final bill on maintenance and/or repair work done to your property initiated by your property management company when using their vendors or in-house maintenance staff. This should be disclosed in your Manager/Owner contract which usually will state the markup as a percentage above the final invoice from vendor. For example, your manager had to call a plumber to replace the dishwasher in your rental property. Total charges for completing the job: 0. If your property manager contract states you will incur a 10% markup on all maintenance work the actual cost to you will be 0. Just one of those things to be aware of as these all eat into your profits.

Early Cancellation Fee

The dreaded "3 months and no tenant". Your property manager insist he or she's doing everything they can to find you a tenant. But here it is 3 months and still no tenant; what do you do. Well, look at your Manager/Owner contract and that might be your deciding factor. I am not a fan of this fee, and believe it to be an unnecessary fee and for you manager out there this could be the deal breaker. I'll tell you why; if a property manager is doing their due diligence and keeping the owners in the loop as far as decision making, market conditions and communication lines open an owner will not be second guessing his property managers abilities. The odds of this scenario happening is unlikely but you must be prepared for it. A cancellation fee can range from none to over 0. To be fair, some managers legitimately deserve this fee especially if they have pocketed advertising costs, incurred lots of legwork and time invested in your property.

"You've Got To Be Kidding Me" Fees - These are ones I have personally had the pleasure of running into.
Your property is vacant, but we still will charge our monthly commission or a small flat fee. "A For-Rent Yard Sign Fee". I believe this was /mo. "Preventive Maintenance Fee". This was to cover the "just in case" and changing out A/C filters. If "just in case" never happens they still pocket the money. I believe this was /mo and I still was charged for filters.
In Summary

Read your Manager/Owner contract, understand what you are signing, ask lots of questions and know what the fees will buy you in services. A good real estate lawyer can help in negotiating the terms in a contract that suit both parties. These contracts are not set in stone. If your property manager will not negotiate, there are other property management companies that are eager to earn your business.

6 Common Teacher Interview Questions and How to Answer Them

When you get a call from a school administrator inviting you to interview for a teaching job, how do you feel? Happy? Elated? Excited? Nervous? Scared stiff?

You don't need to worry about the interview if you're a well-prepared, qualified candidate. Preparing for a teaching interview is a lot like studying for a test. You can review commonly asked questions, think about what you'll say beforehand, and go in to do your best. If you prepare beforehand, the interview questions will seem routine and familiar. You'll have answers on the tip of your tongue, ready-to-go.

6 Common Teacher Interview Questions and How to Answer Them

1. Tell us about yourself.

This will be the first question at almost every interview. Just give a brief background in about three sentences. Tell them what colleges you graduated from, what you're certified to teach, what your teaching & working experiences are, and why you'd love the job.

2. How do you teach to the state standards?

If you interview in the United States, school administrators love to talk about state, local, or national standards! Reassure your interviewer that everything you do ties into standards. Be sure the lesson plans in your portfolio have the state standards typed right on them. When they ask about them, pull out your lesson and show them the close ties between your teaching and the standards.

3. How will you prepare students for standardized assessments?

There are standardized assessments at almost every grade level. Be sure you know the names of the tests. Talk about your experiences preparing students. You'll get bonus points if you know and describe the format of the test because that will prove your familiarity.

4. Describe your discipline philosophy.

You use lots of positive reinforcement. You are firm, but you don't yell. You have appropriate consequences for inappropriate behavior. You have your classroom rules posted clearly on the walls. You set common routines that students follow. You adhere to the school's discipline guidelines. Also, emphasize that you suspect discipline problems will be minimal because your lessons are very interesting and engaging to students. Don't tell the interviewer that you "send kids to the principal's office" whenever there is a problem. You should be able to handle most discipline problems on your own. Only students who have committed very serious behavior problems should be sent to the office.

5. How do you make sure you meet the needs of a student with an IEP?

An IEP is an "individualized education plan." Students with special needs will be given an IEP, or a list of things that you must do when teaching the child. An IEP might include anything from "additional time for testing" to "needs all test questions read aloud" to "needs to use braille textbook." How do you ensure you're meeting the needs of a student with an IEP? First, read the IEP carefully. If you have questions, consult a special education teacher, counselor, or other staff member who can help you. Then, you just make sure you follow the requirements on the IEP word for word. When necessary, you may be asked to attend a meeting in which you can make suggestions for updating the IEP. Your goal, and the goal of the IEP, is to make sure the student has whatever he or she needs to be successful in your class.

6. How do you communicate with parents?

This question will come up at almost every elementary school interview. It's fairly common in the middle school and high school as well. You might have a weekly parent newsletter that you send home each week. For grades 3 and up, you may require students to have an assignment book that has to be signed each night. This way, parents know what assignments are given and when projects are due. When there are discipline problems you call home and talk to parents. It's important to have an open-door policy and invite parents to share their concerns at any time.

2. DV, Spousal Abuse and intimate partner abuse statistics come from only two major sources, Agency Data and Survey Data. The problem with the data is that it is biased because it is too varied, complex and partially unvolunteering.

3 Fact: DV shelters funded by the Federal Government are not required to produce information and do not, information about what they do, how many numbers in or out is unknown, statistics and algorythims are not recorded, this does not help determine if domestic violence is rising or decreasing.

55. It was in 1984 that the United States Attorney General suggest that automatic arrest become standard when responding to a domestic violence call.

Juice Plus Review

Is Juice Plus a Scam?

Juice Plus is a supplement that has been in existence since 1993. I looked into the product at one time as a possible source of nutritional benefit for my family. I was even interested in becoming a distributor so that I could earn a residual income, since so many people are looking for ways to improve their nutrition just like you and I. I will not say outright that the Juice Plus is a scam. I have thoroughly looked into many business opportunities, especially health related companies, and I will say that there are many fraud companies out there. I think that Juice Plus is actually one of the better companies out there, but in my search for the best quality source of vitamins, minerals, antioxidants, and general nutritional supplements... a little bit of research let me know that Juice Plus+ was not for me. Let me tell you why I decided that it was not for me.

Juice Plus is manufactured by a company called Natural Alternatives International in Santa Monica, California and distributed by National Safety Associates (NSA) in Tennessee. NSA was started in 1970 and before introducing Juice Plus, was known for other multilevel-marketed products. Juice Plus scam? No, they are just a smart company that seems to follow the business trends of the decades. Do you remember all of those water filter companies that were popular in the 1980s? Well this company sold home fire detectors when they were popular in the 70s, water filters in the early 80s, and air filters in the late 80s. They also sold educational games at one point.

While some companies in the past have made multilevel-marketing look bad, there is nothing wrong with using the method of sales distribution known as multilevel-marketing. If done right, it can benefit more people than traditional marketing, save people money and can also help get a product out to many who may have never learned about the product.

So from a business standpoint, it looks like they have the right idea. They follow the trends.

The Juice Plus Products

Their main products are the Juice Plus, which are not juice really, but powder in capsules. This is better than juice because juice supplements like the popular Acai berry juice, noni juice, Mona vie juice or Mangosteen juice products will begin to oxidate as soon as you open the bottle. This liquid oxidation is harmful to the body. The Juice Plus blend include great ingredients that come from fruits such as acerola berries, apples, cranberries, oranges, papaya, peaches, and pineapple. Their Juice Plus+ contains vegetables that are sourced from barley, beets, broccoli, cabbage, carrots, kale, oats, parsley, spinach, and tomato. So to answer the question is Juice Plus fraud, I say that there is no Juice Plus scam, since they sell real products with decent ingredients.

It has become general knowledge that by increasing your fruit and vegetable intake on a daily basis, that you can improve your health and wellness. Eating more fruits and vegetables will actually help your body also get rid of free radical cells as well as a natural antioxidant in the body. I just do not feel that this product has enough fruits and vegetables in it for me is all.

A Few Juicy Problems

Their Juice Plus Gummies supplement for kids were found to have around 80% corn syrup and 10% beef gelatin, making the product almost without nutritional benefit. So these are not much better than the gummy vitamin/mineral bears that you can buy at your local store. Both are basically just candy!

I assume that their other products probably have a higher quality of nutrition than this but I saw some other problems that made me shy away.

The Biggest Problem

I could not find any of the product labels on their site.

The biggest problem that I saw was that in all of the poking around on their company website, I could not find any of the product labels for any of their products! What are they trying to hide? Sure they list a few fruits and vegetables, but they don't say how much of each fruit that they use. They don't show you the nutritional facts so you can see how much sugar and natural or artificial ingredients are in each product.

I did not like that I had to buy the product to see the product labels.

Some other problems that I saw ...

1. The products were not unique enough

2. There was not enough research and science

3. The testimonials were lacking

4. The products were not manufactured to high enough standards to make me want to pay the extra money for them

5. Not all of their ingredients were organic and/or plant-based.

Juice Plus Research

One thing that caught my interest when first evaluating Juice Plus was that the product had at least been in scientific journals such as Asia Pacific Journal of Clinical Nutrition, Evidence-Based Complementary & Alternative Medicine, Nutrition Research, Journal of Human Nutrition and Dietetics and Integrative Medicine.

But wait a second! I soon discovered that of the the published peer-reviewed studies, only one was conducted independently! The others were all funded and/or authored by the manufacturer, the main distributor, or by individual Juice Plus distributors. That made me a little leery!

Juice Plus Testimonials

One serious mistake that was made, was in choosing former professional football player O.J. Simpson to be celebrity endorser of the product. Simpson was given a multi-year six-figure contract to sign on with NSA as a icon for the company. I personally like to see a company that has a product that is so good that star athletes use the supplement on their own, simply because they like the added performance gain and benefits that they get while using them.

The testimonial of O.J. Simpson was thrown even further out after he was charged with murdering his wife and her friend Ronald Goldman. In March of 1994, shortly before these murders took place, he was videotaped telling 4,000 Juice Plus distributors at a sales meeting that Juice Plus+ had cured his arthritis, enhanced his golf game, and freed him from needing to use anti-arthritic drugs. However, his defense attorneys in the criminal trial in 1995 and civil trial in 1997 (and in his 2007 book If I Did It) all suggested that Simpson was so handicapped by arthritis that he could not have committed the murders. They also went on to say that Simpson was using a variety of potent anti-inflammatory drugs, such as sulfasalazine and ibuprofen. Well, these may have been what improved his arthritis enough to allow him to have an enhanced golf game.

My Conclusion

In conclusion, I looked into them as a health product and as a source for a second income, since they use the residual income model which I like. To answer the question is Juice Plus a Scam? No I don't believe Juice Plus is a scam, but Juice Plus was not for me. You should do your own research. I found an alternative that I am extremely happy with.

America's Top Ten Trout Fishing Streams

I'm going seriously out on a limb by naming the top 10 trout rivers in the country. I will doubtless leave out some rivers that are worthy of mention. But when it comes to a list like this, you have to eventually pick the streams, and I'll apologize in advance if I don't put you're favorite river down. I'm sure these aren't actually the ten very best streams around-there are dozens of backcountry Alaskan streams and private trout waters that are probably better than any of these. But these are all rivers that are easily accessible and provide awesome trout fishing. These are all well known streams, and they'll be crowded from time to time. Still, they're all long rivers and there is room to spread out. It's no coincidence that Montana is well represented in the list;it is full of long, beautiful trout rivers.

1. Gallatin River (Yellowstone National Park and Montana)

This will come as a bit of a surprise that I'm listing this as #1. It's one of those streams that everyone loves, but usually plays second fiddle to other famous rivers in the Yellowstone area. Most folks spend most of their trip on the really "classy" trout streams, like the Madison, Yellowstone, Firehole, or the Paradise valley spring creeks. The Gallatin is just that friendly little river that courses through gorgeous mountain territory and produces some small trout. The beautiful mountain meadow water in Yellowstone National Park, and for a few miles below holds several hundred small rainbows and cutthroat in it's plentiful riffles. You won't find the thousands of trout per mile that you'll find on the Madison, or the 20" browns, but it doesn't get any more beautiful and the fish usually aren't at all fussy. Access is easy and ample. Downstream, it gains power and roars through a whitewater canyon. It's no longer an easy going meadow stream, but the trout numbers, and size of the fish, get steadily better. Below the canyon, the stream spills out into a wide sagebrush valley populated by elk and moose. Especially below the mouth of the East Gallatin, big browns begin to show up in good numbers under the undercut banks. This is good float fishing water, although waders can do well also. Finally, the Gallitin finds it's way to Three Forks where the it helps form the mighty Missouri. The Missouri itself is an awesome trout stream, and it's the next stream on our list.

2. Missouri River (Montana)

The Missouri River begins as a high plains river at Three Forks, Montana. From the river's headwaters downstream to Holter dam, the river flows slowly, both as a free-flowing river and as reservoirs. This portion of the river has some excellent trout fishing during the spring and the fall. The fish here are almost all browns, although a few rainbows come up from the lakes that are located on the river. During the summer, whitefish form most of the action. Browns can still be caught, but they mostly become sluggish, or even move to the deep waters of the lakes.

Below Holter Dam, the Missouri becomes a tailwater stream. This is where most people go to fish the Missouri. The cold outflow from Holter Dam creates a habitat where trout can survive well throughout the year. Rainbows are much more common than further upstream, but browns are also present. The fishing remains excellent downstream to Cascade;it fishes decently all the way to Great Falls.

3. Madison River (Yellowstone National Park and Montana)

The Madison River begins as an odd spring creek in Yellowstone National Park. The reason it is so odd is that it is fed by both cold and hot springs that make their way into it's two feeder streams, the Firehole and Gibbon. It fishes best in this upper portion in the late spring, early summer, and fall. During the summer, the water often grows too warm to allow the trout to feed, because of the hot springs. Rainbows and browns in the 10-14" range are the primary residents,but in spring, large rainbows move up from Hebgen Lake. In the fall, large browns, also from Hebgen, do the same. Dry flies are standard fare for the residents. The migratory rainbows and browns prefer gaudy streamers and wet flies fished deep.

Below Hebgen Dam, there is a run of a few miles before the Madison slows back down into Quake Lake. There is a resident trout population in this stretch which is augmented by spawning runs from Quake Lake during the spring and fall. The summer fishery is somewhat better than the river above Hebgen, but the spring run of rainbows, and the fall run of browns are still the main event. Below Quake Lake, the Madison becomes a beautiful freestone trout river. It begins a run to Ennis Lake known as the 100 mile riffle. This is all fast water, but serious rapids are rare. Rainbows and browns hold in the slow water along the banks, as well as behind the many mid-stream boulders. The scenery is breathtaking, with the lush Madison valley in the foreground, and the towering mountains of Yellowstone in the background. This is the 100 most fabled miles of trout water in the country, and possibly in the world. It can be floated or waded.

Below Ennis Lake, the river drops into Beartrap Canyon. The canyon is full of big rainbows and browns, but it's a long hike to get to the river. Still, it's probably worth it, as this relatively unfished water provides nearly as good of fishing as the water above Ennis. Below the canyon, the river drops into an arid valley, where it meanders from one undercut bank to another. This is excellent brown trout water, but it gets too warm in the summer. Spring and fall are good times to target the good numbers of browns here.

4. Yellowstone River (Yellowstone National Park and Montana)

Yes, this is the fourth Montana stream on the list. The Yellowstone simply can't be left out of any list of top trout waters, as it provides 250 miles of some of the most beautiful and heartstopping trout fishing in the world. The fishing begins deep in the Thoroughfare region of Wyoming. There's no easy way to reach this water. It take's a long hike and a dedication of a week or so to fish this water the way it should be fished. This is cutthroat water, with both resident fish and migratory trout from Yellowstone Lake. This is as deep in the wildnerness as you can get in the lower 48, and you must be sure you can be totally self-sufficient. In the case of an accident, you'll be on you're own. Also, Grizzlies, black bear, moose, and other dangerous creatures are common. That can be a deterrent or an attraction. You decide for yourself.

The river is much more civilized below Yellowstone Lake. Although it flows through country that has been left in it's natural state by Yellowstone National Park, it's far from wild. The park water is heavily fished, especially in the popular Buffalo Ford area. Cutthroat trout fishing isn't as glorious as it used to be, but it's still quite good. The river drops into the Grand Canyon of the Yellowstone, and then the Black Canyon. Those stretches are essentially unfishable. When it enters Montana, it once again becomes a great trout stream. It is a very readable mountain stream just below the park, with many pools and riffles that hold both rainbows and cutthroat. Below, it enters yet another canyon, this one called Yankee Jim. The canyon is hard to hike into, but the pocket water holds some rainbows, and they aren't fished very often.

Below Yankee Jim canyon, the Yellowstone settles into the character it will hold for another hundred miles or so. It flows through a beautiful valley (although you can see the beautiful Absaroka Mountains most of the time), and the river has a steady, but not rapid current. This is rainbow and brown trout water in the main, although cutthroat are pretty common as well. The water around Livingston is most famous, but the fishing is very good for many miles up and downstream from that popular western trout town. The trout fishing holds up all the way downstream to Billings in Eastern Montana. Below there, it is a massive prairie river home to pike, smallmouth bass, and catfish, but few trout.

5. Green River (Wyoming and Utah)

The Green River is a stream with many faces. In it's upper reaches in Wyoming, it's a high plains river home to large brown trout. This is western ranchland country, and all through the summer trout hug the undercut banks in search of hoppers. That's where you should be casting, with a Letort Hopper and maybe a Hare's Ear dropper for good measure. The access isn't great here, but there are places where visiting anglers can get on productive water for free.

The upper Green finally flows into Flaming Gorge Reservoir. The reservoir is home to big rainbow, brown, and lake trout, but it's deep waters are hard to handle with conventional tackle, especially if you prefer to fly fish. The tailwater (which is actually in Utah), however, has some of the best trout populations on Earth. Some estimates show nearly 20,000 trout per mile in the first 7 miles below the dam. The tailwater is best known for it's cutthroats, but it also fishes well for rainbows and browns. This river flows through a beautiful desert canyon. The water is air-clear, and site fishing is very popular. Further down, there are a few less trout, but the browns and rainbows can grow much larger. If you don't have a boat, we recommend hiking in to some of the lesser known areas. You'll find wilderness fishing on one of the most productive trout streams in the country. Local fly and tackle shops will be able to point you in the right direction. Just watch out for Rattlesnakes! There are also formal accesses where you can fish, including one right below the dam. You can catch fish in these areas, but the wilderness experience is mostly lost. Most people who are new to the Green float it in a driftboat with a guide. The guide will safely bring you through the whitewater and put you over fish. Just don't expect it to be cheap.

6. White River-Bull Shoals Tailwater (Arkansas)

Arkansas's White River is the only Southern stream on our list, and it's also the only one that's mostly put and take. This tailwater flows out of Bull Shoals Dam high in the Ozark Hills. The cold plume from the bottom of Bull Shoals Lake, combined with the cold flows of the North Fork River allow trout to survive for nearly 100 miles below the dam. It's a tailwater with rapidly fluctuation flows, and it can be downright dangerous. It can be waded at low flows, but bank and boat fishing are the only options when there the dam is releasing a lot of water. Your first time floating, a guide will be helpful.

There are about 5000 trout per mile on the river, and the majority are rainbows. Rainbows are stocked by the millions by the Arkansas Game and Fish Commission. Rainbows swarm almost all parts of the river, and they never seem to be difficult to catch. These trout average about 13 inches, so they're fun to catch. Still, the browns are what draw many anglers to the White. The browns are mostly wild, although their numbers are supplemented by stocking. A new 24" minimum insures larger browns, and there are also several catch and release areas on the river. A White River brown isn't considered large until it hits five pounds; it's not a trophy until it hits 10. To give you a frame of reference, on our last trip to the White, a fly shop owner showed us a picture of an honest, weighed and measured brown that he had just caught that weighed 29 pounds. He didn't seem all that excited about it.

7. Manistee River (Michigan)

Michigan's Manistee River is one of the best in the world. It starts deep in the lower Peninsula of Michigan as a small, spring-fed brook trout stream. This isn't the place to come for trophy trout, but the brookies are beautiful and jewel-like, always ready to provide a wonderful experience. A few browns do make their way into this section, and they can grow surprisingly large. While most people fly fishing, spin fishing is both legal and productive.

From the M-72 Bridge downstream to the CCC Bridge, the river is fly- fishing only. There are good numbers of both browns and brookies here, and trophies are much more common than further upstream. This is famous trout water, and the hatches, as well as the fish are plentiful. The restrictive regulations insure top quality fishing. The fishing remains good for a few miles downstream from the special regulation stretch (mostly for browns), before the river forms Tippy Pond.

Below Tippy Pond, the river is a mixed fishery. While smallmouth bass and pike are the main species during the summer, migratory trout, salmon, and steelhead form the cool-weather fishery. King Salmon and brown trout are present in good numbers during the fall. As a matter of fact, a brown trout caught in the lower Manistee last fall is the current world record. Steelhead are in the river mid-fall- mid-spring, and they are quite plentiful.

8. Connecticut River, (New Hampshire and Vermont)

The upper Connecticut River is an Eastern stream with a western feel. Coursing through the beautiful Appalachian country of Northern New England, the scenery will not be beat. The headwaters portion of the river flows through 3rd Connecticut Lake, 2nd Connecticut Lake, 1st Connecticut Lake, and Lake Francis. This portion of the river is full of eager brook trout, and in the spring and fall, Atlantic Salmon run upstream from all of these lakes, and provide excellent sport in the river. There is some water that is legal to fish with a spinning rod, but it's mostly fly fishing only.

Below Lake Francis, the river mostly becomes open to spin fisherman, although fly fishing is still most popular. The Connecticut provides excellent fishing for rainbow and brown trout for many miles downstream. You can wade, fish from the bank, or float this water. This area gives you your best shot to catch large trout. The fishing is good along the New Hampshire/Vermont border all the way down to Hanover, the home of Dartmouth College. It should be noted that there are several slow, dammed up sections of stream in this part of the river that are warm-water fisheries, but where you find good current, you'll find some trout.

9. Niagara River

Did you know that below Niagara Falls, this mighty river is an excellent trout and salmon stream? This is a totally migratory fishery with good numbers of steelhead, brown trout, and various species of salmon. As you may have guessed, this is not an easy river to fish. There are probably some areas that can be fished from the bank, but it would be safe to say that wading is out of the question. There are many guides in the area that will help you out on this beautiful, dangerous river, and we recommend their services to insure a safe trip. This isn't a summer fishery for the most part. Any time during the spring and fall, you'll find some sort of salmonid running up the river. In summer, switch your attention to smallmouth, which are abundant and large.

10. Beaverkill River

Is this one of the 10 best trout streams in the country? Well admittedly, it probably isn't. It's just that the tradition on this stream is so rich that it would seem a sin to leave it off. This famous Catskill River begins as beaver flowage high in the mountains. It's full of eager brook trout up there, and few folks fish it. This water is on public land, so if you'd like to hike in, you may be pleasantly surprised. The first place most people begin their fishing is at the Beaverkill Campground. Browns and brookies both reside in the beautiful fast water environment here, and it's always a pleasant place to fish. Also, it doesn't get nearly as warm in the summer as the lower reaches, so you can probably expect to catch a couple if you have to come in July or August.

The river is mostly private, and therefore off of our radar screen all the way down to Roscoe, New York (also known as Trout Town USA). At this point, the Willowomec (also a nice trout stream) flows in to form the Junction Pool. Many people come all the way out here just to fish that pool;it's synonymous with American dry fly fishing. After this pool, the river remains mostly accessible and has many other areas, such as Cairn's Pool, Horse Brook Run, Cook's Falls Pool, Horton Pool, and the Acid Factory that are legendary in the minds of fisherman. This is all famous trout water, and it fishes well whenever the water temperature is below 70 degree. Sometimes it will be in good, fishable shape all summer long, and at other times the water is so warm it is both irresponsible and unproductive to fish it.

There are only about 300 trout per mile on the Beaverkill, and given it's fairly large size, that's not a terribly high number. Neither is it much of a trophy stream, although admittedly some fine browns are caught from time to time. And therein lies the mystery to it's fame. It's real value lies in the fact that it was one of the streams where American dry fly fishing was pioneered. A trip here is more a lesson in history than an excursion to world class trout water.

These are just ten streams that for one reason or another, we think are worthy of mention. As we said earlier, it's highly debatable whether these are really the ten best. But it is true that these are ten fine trout streams, and they all have some aspects to them that are beautiful.

New Syllabus 2005 - English Language For Secondary Schools, Form I - IV

INTRODUCTION

Tanzania is among African countries, which right after independence started to take measures on education developments through policies formulation, reviews, adjustments, and improvements. These measures include curriculum design and development for schools to meet national goals on education. English as one of the subjects taught in all education levels from primary school to tertiary level, its curriculum and teaching has being gone those changes since then. In viewing and analyzing the English syllabus used in Tanzanian schools particularly in ordinary level now, we should see the changes of last syllabus, which led to the current syllabus we have today. The last syllabus was introduced in 1996 and used up to 2005 where the current syllabus was introduced in use from January. The syllabus was improved to meet the needs, challenges and shortcomings of the former one. Students were given more activities; the syllabus focuses on student competencies rather than the former one, which focus more on contents. The syllabus was challenged that it did not bring competences that is why the standard of English has declined dramatically over the years, and the main cause of this decline is the insufficient teaching of English in schools following the English language syllabus. This was seen by Allen K. (2008) in 'What happened to our good English? And wrote:

'Syllabus and textbooks have caused this... Secondary school students only fare marginally better, and yet secondary and tertiary education is all in English. They may be able to engage in simple dialogue but normally only after they have asked for the question/sentence to be repeated at least once. Again, fluent, complicated structures are mostly not understood at all. Written English is a greater problem. How many secondary school students write the almost nonsensical 'How are you? On my side, I'm fine and going on well with my daily activities'. Recently talking to university graduates who were embarking on post-graduate studies their lack of confidence in the language was striking. To make conversation I needed to adopt very simple structures at a very slow, unnatural speed'.

New Syllabus 2005 - English Language For Secondary Schools, Form I - IV

This was also earlier seen by Cripe C & Dodd W. (1984) that suggested the authorities to work on a completely new syllabus for English language teaching in schools. Such a syllabus could take into account that many more pupils progress to secondary school from primary school without facing English language good foundation.

In that view, this paper analyze the contemporary syllabus, by using some of the criteria including appropriateness, feasibility, utility, adequacy, content, method, scope and consistency between grades. Others are internal consistency, clarity, and up-to-datedness. These criteria will be on its structure, objectives, strengths and weaknesses that avail. It is important to do so in order to improve the standard of English in Tanzania as proficiency in the language. This is because teachers as main guides for instruction in their classrooms use national English syllabuses and in examinations. The syllabus was designed and prepared by Tanzania Institute of Education under the Ministry of Education and Vocational Training.

ANALYSIS

Before the analysis, the definition of syllabus is given as the summary of the course; usually contain specific information about the course. (www.counselingcenter.uiuc.ed). Collins Essential English Dictionary defined syllabus as an outline or summary of the main points of a text or a course study. Syllabus analysis is the evaluation of the quantity of the syllabus (www.counselingcenter.uiuc.ed). So the purpose is to evaluate the quality of it developed by the institution.

The major areas analyzed in this ordinary level English syllabus are top cover, back cover, inside the top cover, part one and part two of it. The top cover present the title starting with United Republic of Tanzania on top then Ministry of Education and Culture now changed to Ministry of Education and Vocational Training, followed by English Language Syllabus for Secondary Schools, Form I - IV, 2005. Inside the cover on page (ii) copyright of the ministry is uttered followed by designed and prepared authority and address i.e. Tanzania Institute of Education. The next page (iii) is the table of contents.

The syllabus generally is divided into two main parts where the first is introduction, objectives of education in Tanzania, objectives of secondary education, general competence for Form I - IV, general objectives and organization of the syllabus. The second part consists of competences and objectives of the class followed by a table matrix layout, which shows topics, sub-topics, specific objectives, patterns/structures, contexts/situations, vocabulary/phrases, teaching/learning strategies, teaching/learning materials, assessments and number of periods with instructional time.

Introduction of the syllabus is well presented shortly expressing that the syllabus replaces the 1996 English Language edition, which has been phased out. It has been introduced for implementation from January 2005. The introduction could have been more attractive if it explained more the major reasons, which led to the phase out or change of the former one. Several inquiry skills and some inquiry levels are very briefly outlined in the introduction; it could be outlined to polish the part.

The objectives of education in Tanzania are clearly stated, meaningful and relevant to Tanzanian context as well as worldwide. They touch all disciplines of skills needed to the human being in the world. This is written the same in all syllabuses for subjects in that level nationally. The objectives are challengeable with the availability of resources in education both physical and human infrastructure in totality to cater the needs. In the report presented in the Conference of Commonwealth Ministers in Halifax, Canada 2000; by the minister of Education and Culture at the time says that; despite the government and the private sector efforts to provide secondary education in the country, the sub-sector had shortage of the science teachers especially in the rural areas, shortage of laboratories, shortage of equipments and other basic educational materials... It means that the objectives are clearly stated but not easy to achieve successfully.

The following section analyses the feasibility of the objectives of secondary education in Tanzania. The part started by defining the secondary education as a post primary formal education offers to learners who successfully completed seven years of primary education and have met the requisite entry qualification requirements. The objectives are stated to make the syllabus implement-able and feasible. However, it carries elements of behaviorists' approaches that emphasize the use of reinforcement and repetition. The challenge is how to fulfill the packages needed to meet those objectives. Obanya P. (2006) had seen it and pointed out that Africa is still trailing behind other regions of the world in its effort towards attaining the EFA (Education for All) goals. So to Tanzania among African countries. Further he said the successes and sustainability of the new vision of secondary school in African governments show an appropriate level of political will...stepping up the process of reform, mobilizing the required resources, ensuring a participatory process etc.

General competences for Form I - IV in part two are relevant and if they are to be, achieved changes are to be seen. Competences were added to this syllabus to meet the objectives of teaching English in secondary schools by focusing on the learner-centered education (LCE) rather than teacher centered education (TCE) which proved insufficient masterly of language formerly. Allen K; (ibid) supported the transformation and said that things could have improved in the early 2000s with the opening up of the school textbook market to private publishers and the permitted multi-textbooks. However, the standards in teaching English had already declined by then, and many teachers were not equipped to be able to choose the best books for their purposes. Teachers have mostly taken the multi-textbook system to mean that they choose one book from a selection of many, and so they still effectively only use one textbook. In really sense, general competences collaborate with national objectives.

The syllabus has utility and efficacy that is why general objectives are outlined to enable the student acquires knowledge and skills to practice and use the language in specific settings and remarkable performances. They include speaking and writing skills, reading skills, communication and demonstration skills. These are form of skills which Burt C. et al (1933) categorized them as skills, concepts, relationships and strategies. They said that these four categories should not be thought of a hierarchically linked in the learning process, they are to large extent interactive. If a student acquire the outlined objectives thoroughly she/he would be competent to use English language in the world of information and communication technologies. It is clearly seen that these objectives were derived from the national objectives because they comply with them.

Class level competences are the statements, which specify the abilities that are expected to be attained by students before the class objectives found at the beginning of the content of each class level. Objectives are statements of behavior that are stated immediately after class competences to be exhibited by each student at the end of given class. These are achievable in a class of a recommended number of students not exceeding thirty five in class at a time and with the competence of a teacher. However, in Tanzanian crowded classes environment of more than sixty students is very difficult to achieve such objectives. Sumra S. (2000) pointed out that the education policy needs to clarify in focusing on 'inputs' or 'outputs' and the meaning of - what is expected of all teachers and how this will be monitored and measured. Pre and in-service needs to be focused on teacher competence. The effectiveness of human and physical infrastructures should be assured and realized in our schools so that the objectives are achieved.

Class level competencies and objectives in each Form are not the same. They are articulated according to the topics arrangements in specific Form and the behavioral changes intended. Class level competence is appropriate in scope versus students' ability level. The new approach shifts the orientation of the content largely, but not exclusively, away from the rote memorization of factual knowledge to a competence based learning, which focuses much more on the understanding of concepts, and the acquisition of skills and competences.

The organization of topics and sub-topics, which are in the first and second column of the syllabus layout, shows that are completely designed to students ability. They diminish in number sequentially and consistent as they go to upper Form. While in Form I, there were sixteen topics and twenty-four subtopics, in Form II there were eleven topics and fifteen subtopics. In Form III and IV, there were six and five topics, fifteen and fourteen subtopics respectively. Some topics recur more than once but in advanced form. For instance, 'Expressing Opinion and Feelings' appeared in Form I, II, and III. 'Talking about Events' and 'Interpreting Literary work' appeared in Form I and II, while ' Listening for Information from different Sources', 'Reading Literary Work' and 'Writing Appropriate Language Content and Style' appeared in Form III and IV respectively. However, the topics are consistent and have sequential arrangements. The entire syllabus has credential internal consistency between components and their content scope.

In organizing the topics and other sub-heading, the structure of the syllabus is in matrix form layout. Form I classes for example have sixteen topics and twenty-four subtopics. Both are relevant to their level and the continuity of topics is maintained accordingly from simple to difficult and there is a link between them. The same applies up to Form IV. The objectives in each topic and subtopics are clearly articulated from Form I - IV, to meet the behavioral change intended. The analysis of topics and sub-topics show that there is continuity within and link between topics because sub-topics are presented under the main topics. This enables a teacher to understand and relate the topics with concepts and ideas. Change of behavior is taken into consideration during planning the lesson to teach to make sure the autonomy is attained. Autonomy refers to student's ability to organize his/her own learning activities.

Patterns or structures and variety of activities are relevant and adequately in providing, enough learning in every Form presented in the syllabus. It suggests use of variety activities including demonstration, dramatization, dialogue oral and written drills, songs, role-plays and games. These activities bring a vital role to students to master language skills, however, the nature of most Tanzanian crowded classes and shortage of teachers, this is a challenge to achieve successfully.

Context/Situations are provided in abundance and this will depend on how the responsible teacher opts to them depending on the natural setting of learning environment. Natural setting help the students the knowledge of skills they attain in their environment even after school. Vocabularies and phrases option provided are enough and relevant to the level of students.

The syllabus is adequate because in teaching and learning strategies throughout the syllabus, students are intended to develop fully speaking, writing, listening and arguing skills. They are adequately assisting the learners to attain the objectives. It is recommended that the list is not exhausted that the teacher will use more strategies depending on the needs where necessary. These include ear training, pronunciation and writing by using directives given in patterns/structures in third column of the syllabus.

There is no doubt about teaching and learning materials because they are well presented and suggested. The only slight doubt is that in rural areas, it might be difficult to access on television, video and audio cassettes because of shortage of power supply but with initiatives, it can be solved out. The levels of inquiry require students to be able to do something in the assessment and this is very well articulated in the part. There are one hundred and eighty four periods in a year, which shows at least there are seven periods in Form I and II; six periods in a week for Form III and IV. Each period is forty minutes.

The syllabus does not give suggestions, advice, or alternative program or prospectus to be used together or in place of itself. Again, it does not provide a list of selected text and reference books. It would be better if at least five textbooks and five reference books could be suggested in each topic. The national English syllabus serves as one of the main resources for English teaching and learning in secondary schools. Each teacher is given a copy of the national syllabus as a guide for the scope and depth of the content to be taught.

Inquiry is explicitly emphasized in the assessments section in the secondary school syllabus. This syllabus aims at stimulating pupils' curiosity and sense of enquiry which will in turn not only provide suitable basis for further study of the subject but also provide students with sufficient knowledge and understanding to make them become useful and confident citizens. The essence of such an enquiry is related to problem solving and reflecting on modern enterprise. During the course, students should acquire language abilities associated with language competences. Students should develop second language attitudes such as open mindedness and willingness to recognize alternative language skills of view. Moulali S. (2006) said that the main objective of education quality improvement is to have a market responsive curriculum, with an efficient and effective delivery system that enables the recipient to become confident in modern enterprise.

In the assessment also, the teacher is required to make sure that students are assessed in all objectives into considerations of learning outcomes. It is explained that assessment provides room for fairness as well as enhancing students' development of high level of thinking. The teacher must assess students in all language skills using paper pencil assessment, interviews, observation, portfolios, projects and questionnaires. These are the most techniques for active and participative learning. Active learning or learner-centered education (LCE) is considered an effective antidote to the prevalence of teacher-centered instructional classroom practices, which is widely claimed to support passive learning, and the stifling of critical and creative thinking (Rowell and Prophet 1990). The promotion of LCE is directly associated with high development ambitions, such as economic development, or social restructuring. LCE fits well modern pedagogical ideals for focusing on the provision of a platform for developing knowledge, skills and competencies for innovation, social development and economic growth. LCE requires a move from the commonly pure content learning and the memorization of facts to the ability of learning-to-learn, to the inclusion of methodological and social skills and competencies into the learning process, to the understanding of generic higher order concepts.

DISCUSSION AND RECOMMENDATIONS

In totality the syllabus is well organized and presented successfully to meet the intended outcomes. It has the desirable aspects of quality, continuity, autonomy and discussion. It is also updated because it is relevant to current situation of the nation and the world as a whole. Such current issues include HIV Aids in Form II, ozone layer depletion global warming and environmental conservasation in Form III.

The objectives and competences are clearly constructed and stated to meet intended outcomes including national and individual goals in English language skills. Language is vital for everyone to communicate and this is where the access to cognitive skills, knowledge, technologies, attitudes and values can be obtained. The objective of this syllabus is to have a responsive curriculum that addresses the skill needs of the population and an efficient and effective delivery system of the curriculum. This would mean an adequate and qualified number of teachers, as well as sufficient and appropriate teaching and learning materials O-saki, K., & A. Ndabili. (2003). They should be available in all schools to raise student achievement, and appropriate mechanisms for testing learning competencies. This is a challenge in Tanzanian context but (World Bank Report 2007) said that to achieve education goal emphasis must be directed in expanding facilities through the provision of development grants to schools. Policy measures such as raising the average number of students per teacher, increasing the average number of teaching periods per week, increasing class size, especially at upper secondary, expanding open and distance learning programs, reducing tuition fees by half, and providing scholarships to students from poor household.

As previously mentioned the syllabus does not list a number of text and reference books to use at least five each Form. This is left to school administration and subject teacher to choose various books to use. This is a very good decision but the challenge is; can all schools manage to buy these books according to the needs? The answer is no even private schools in spite of their school fees collection cannot affect their textbooks needs. African Development Bank, (2000) remark that the bulk supply of textbooks to schools was found to be inefficient as the supply of the books is not always based on accurate information about the schools. This approach of providing textbooks also does not encourage the flourishing of local publishers and local book suppliers. Under SEDP (secondary education development program), the schools are receiving capitation grants which they use for the purchase of learning and teaching materials, including textbooks. This enables the schools to procure the books they need and in the quantities they can afford, but not the recommended needs.

The assessment section of the syllabus state that at the end of Form IV students are expected to do an overall achievement assessment intended to determine the extent to which the objectives of English course have been attained. This can be attained if in all stages of teaching and learning process, (LCE) was adhered with sufficient supply of learning materials. Several studies indicate that implementation of LCE in the classroom is problematic (Jansen 1999; Chisholm 2000; Leyendecker 2002; Ottevanger 2001). Where Sub-Saharan Africa (SSA) countries have attempted to implement learner-centered education, the actual instructional processes were largely far removed from the ideal. One of the problems is that the teacher is regarded by the societies and culturally determined understandings of authority and teaching, including students' perceptions, as the provider of knowledge and the bearer of authority. These perceptions and the resulting classroom behavior will not change overnight. Although Prophet's report dates back to 1995, his observation that teachers rather adapt their teaching to suit their and their students "world view" and perceptions on teaching, is continuously repeated and supported by other studies.

Another challenge is that, contrary to the pedagogical ideal, the vast majority of students are not very active and visible, probably because they have never given the chance. Although there is little research about students' experiences of curriculum reforms, numerous comments and observations, point to the fact that students struggle with their new roles, which they are assigned by the intended curriculum changes. Students frequently share with teachers a common perception about what it means to teach, and are resistant to changes not fitting this perception. What is more, students' attitudes concerning learning and discipline have embraced aspects of international youth cultures. Students welcoming the opening of classrooms and the change from strict classroom organization and discipline, have problems in meaningfully filling the added space and freedom. Students are powerful influencers of change, and can be obstructive if the required attitudes and instructional practices do not fit their expectations. This is happening in various secondary schools in our country. Both student and teachers cannot jump from the current classroom situation and culture to a desirable ideal behavior. It needs transitional time for changes to be instilled in the mind of teachers and students. However, both can gradually grow and adapt to the new roles that are beneficial to teaching and learning. For such a process of growth to take place, support structures should to be available, but these are often absent or very limited in scope and time lines.

SUGGESTIONS AND CONCLUSION

As to conclude, the main practical challenges for the improvement of syllabus and instructional quality that are frequently neglected for the development is that, teachers need to have sound knowledge of the content matter to be flexible to adjust to different ways of student thinking, and to be able to relate to the emerging questions and problems without being challenged in his position. Due to their own learning experiences and education, the content knowledge of many teachers in Tanzanian classrooms is limited, so in-service programs to sharpen teachers knowledge is essential. Teachers need to have a sound knowledge of instructional methodologies, their aims and potentialities. Teachers need assistance and space for learning about instructional methodologies. Teachers' roles change from providers of knowledge to facilitators, and the changes in roles need to be both comprehended and accepted by teachers, students, and the society alike.
